No criminal charges filed in fatal Wisconsin car accident

For families in Wisconsin, learning that one of their loved ones died unexpectedly as a result of another's actions is a great shock. This accident occurred in Feb. 2016. Reports indicate that the 18-year-old victim was parked on the shoulder of the road after his vehicle ran out of gas. Unfortunately, he was allegedly struck by a car that is said to have crossed the fog line onto the shoulder.

Police say that an investigation revealed that impairment or distraction from a cellphone were not factors in the accident. They claim that the driver saw the pedestrian but was prevented from changing lanes due to other traffic. However, the driver is then said to have swerved across the fog line, striking the young man who was fueling his vehicle. The driver reportedly remained at the scene and cooperated with the investigation. While it has been decided that no criminal charges will be filed, the driver will receive a citation for unsafe lane deviation.

A car accident such as this leaves a gaping hole in a family. While attempting to cope with their emotional recovery, many victims in Wisconsin are also left facing financial concerns. Fortunately, these victims have the option of filing a lawsuit in civil court. Because the civil court requires a lower burden of proof, families can seek justice regardless of whether criminal charges are filed.
