Wisconsin car accident kills 1, 1 other in critical condition

Driving on Wisconsin roadways can be dangerous. Most Wisconsin residents know that when they drive, they must guard against inexperience, reckless or sleepy drivers. Every now and then, a car accident can prove fatal no matter how many precautions someone takes. Due to a sleepy driver, a recent accident has resulted in a fatality and injuries.

Authorities indicate that a 37-year-old woman and a 34-year-old passenger were traveling on the highway when the driver of a truck cut across the median resulting in a head-on collision. After the impact, the woman’s car landed in a ditch. The passenger in the woman’s vehicle sustained critical injuries and was hospitalized following the accident.

The driver of the truck and his passenger sustained mild injuries and were released from the hospital the same day. Reportedly, drinking and driving is not a factor in this case, however, authorities believe that the driver may have been fatigued at the time of the crash. At this time, the driver has not been cited for the crash, however, the investigation is ongoing.

When an individual dies as a result of a car accident, it causes emotional turmoil for his or her loved ones. The family of the woman who died in this accident may be entitled to file a wrongful death claim against the driver. Similarly, the passenger in the woman’s vehicle may be entitled to file a personal injury claim against the driver for financial loss such as lost wages, pain and suffering and medical expenses. Successfully litigated civil claims could lead to the court system in Wisconsin awarding monetary damages to the victims, when the evidence demonstrates that negligence from another party caused death or injury of another.
