There are many things which could put a motorist in danger when driving on the road. Many times there are unforeseen obstacles on the road, such as a fallen tree. Even the weather can play a significant role in causing an accident. However, one of the most common causes of car crashes are other drivers and their unpredictable actions. This may be what recently happened in a car accident in Wisconsin which resulted in a fatality.
The incident happened in mid-November when a 44-year-old man was driving his ATV southbound. Apparently the man was leaving an ATV trail and was crossing the highway when a 2009 Honda Accord crashed into his ATV. The man riding the ATV was seriously injured and ended up dying at the scene of the crash.
The Honda Accord was being driven by a 64-year-old male motorist while a 56-year-old woman was riding as a passenger in the car at the time of the collision. Both the driver of the Honda and his passenger were transported via ambulance to a nearby medical facility. They were both treated for non-life-threatening injuries. The local sheriff’s department and the State Police are currently investigating the incident in order to reveal what had really happened and determine who may be at fault in the crash.
The decedent’s family may be able to file a wrongful death lawsuit against the party who they believe to be the cause of the car accident in Wisconsin. However, those injured in the car accident may also be able to file their own lawsuit against the estate of the decedent if they believe the decedent was the cause of the crash which resulted in their injuries. Ultimately, the court will decide who is legally at fault in the crash. The party with the strongest legal argument backed by evidence will have the best chances of prevailing.
